CBD Oil In Idaho

Following the legalization of CBD oil in Boise Idaho, it has become increasingly popular. This legalization can be attributed to the efforts of very devoted activists and researchers like Dr. Sanjay Gupta, who is also the Chief Medical Correspondent of CNN.

If you factor in the outlaw perception, sophisticated composition and questionable legal status in some states, cannabis will always be somewhat of a mystery. However, Cannabidiol (CBD) oil, an extract from the cannabis plant, has been enjoying a revered status for a while now. But what exactly is CBD oil and is it the same as cannabis oil? This article answers these questions while also shedding light on CBD oil laws in Idaho.

The Difference between CBD Oil and Cannabis Oil

The key selling point of CBD oil is that it has negligible amounts of THC, if any. It means that CBD oil focuses on having a high content of CBD. Plus, CBD oil can be derived from either cannabis or hemp. In contrast, cannabis oil is made using marijuana strains and contains a high content of THC. It could contain between 50 and 80% of THC. Thanks to its low THC content, CBD oil is now used extensively as a form of medication in treating:

  • Chronic pain and inflammation
  • Fighting cancer
  • Relieving nausea
  • Reducing anxiety
  • Post-traumatic stress disorder
  • Crohn’s disease
  • Insomnia
  • Acne

Cannabis oil became famous after Rick Simpson, a Canadian, started distributing and marketing the concentrate as medicine. This is one of the reasons that attributed to the research of the potential health benefits of cannabis. Like CBD oil, it’s alleged that cannabis oil also confers medical health benefits. More specifically, it helps in

  • Cancer prevention
  • Muscle sclerosis treatment
  • Diabetes
  • Asthma
  • Epilepsy

CBD Oil Legal Status in Idaho

Idaho is one of the states that has not embraced CBD oil as a medical cure. According to Idaho laws, only hemp-derived CBD oil is legal, which means that any form of CBD oil derived from cannabis is illicit. In fact, possession of small amounts of marijuana-derived CBD oil is considered a misdemeanor crime. And even then, the road to legalizing hemp-derived CBD oil has not been easy.

As early as 1927, Idaho legislators choose to outlaw the drug at a time when the majority of states were decriminalizing cannabis. The then mayor of Boise raised concerns, stating that smoking cigarettes or pipes of marijuana was pretty demoralizing.

Back in 2015, Idaho legislators passed a law- the Senate Bill 1146aa- also referred to as the ‘Alexis Law’. This bill would have given legal defense to parents of kids who use CBD oil as treatment for epileptic seizures. But when the bill reached Gov. Clement Leroy’s desk, he vetoed it. This was despite of the immense support that the bill had received from both sides.

Three years down the line, and the same bill was rejected a second time. In the 2018 legislative session, Representative Dorothy Moon tabled House Bill 410, hoping to legalize medical use of CBD oil in Idaho. After numerous consultations and debates, the bill was unanimously passed by the Health and Welfare Committee, allowing it to proceed to the next stage, where it would be debated upon by the House members.

Luckily, the bill passed this stage too as it garnered a supermajority vote. Unfortunately, the medical CBD bill was eventually killed by the Idaho State Senate in an allegedly illegal meeting. With this last attempt to decriminalize CBD oil going down the drain, it’s likely that Idaho will not legalize marijuana-derived CBD oil anytime soon.
